The lessons of Enron
The collapse of Enron exposed serious weaknesses in US laws governing corporate conduct and financial disclosure, resulting in sweeping legislative and regulatory changes in the way publicly-held companies are governed. Unfortunately, serious corporate scandals have not been limited to the United States. In other jurisdictions the responses to these issues have differed in both nature and degree.
Neal Batson, the Examiner in the Enron bankruptcy, will provide the keynote address and moderate discussion on the lessons of Enron. The panel will feature distinguished participants from a number of jurisdictions. The discussion will emphasise contrasting approaches to dealing with Enron-related problems, actual and potential problems arising from differing approaches and the prospects for future evolution of legislative and regulatory responses.

Government regulation and hot issues in the globalisation of the profession
This joint session between the Bar Issues Commission and the Standing Committee on the Globalisation of the Profession will focus on the trend toward government regulation of the profession and other challenges created by globalisation.
The morning session will discuss reaction to the UK Clementi Report, the EU Competition Review and movement by other governments to regulate the activities of lawyers, particularly through competition law. A mixture of leading regulators and members of the private bar will debate these challenges to the self-regulation of the profession.
The initial findings of the Clementi Report and the EU Competition Review will be discussed at a Bar Leaders' Meeting in Washington in May. A report of that meeting will be available from the IBA Website in July (www.ibanet.org/auckland).
The afternoon session will follow the traditional practice of addressing the crucial issues that directly impact the profession as a result of globalisation. This highly interactive debate will continue to encourage significant audience participation.

Corporate social responsibility and human rights: the impact on lawyers and clients
As the business world increasingly recognises the concept of human rights, the role of the lawyer increases in importance. The growth of legal instruments to cater to these changes puts lawyers under greater pressure to provide sound advice. In this session, leading chief executives and lawyers with corporate social responsibility experience will discuss developing CSR issues, including:
- the extent to which codes of conduct are legally binding on multinationals;
- new areas of liability for lawyers;
- the practical role of the lawyer in advising business clients;
- developments in law with a direct or indirect impact on corporate activity.
This session will help provide answers by reviewing the business and legal cases for corporate social responsibility.

The great migration
As lawyers and their spouses travel to New Zealand from far away places, many will wonder how this remote but beautiful place was discovered and developed. A panel of speakers will examine how a small and diverse country, aligned to neither the West nor the East, is finding itself and its uniquely 'Pacific' culture and is seeking to solve the dilemmas of modern existence in its own way.
The session will include:
- an exploration of the story of New Zealand - Aotearoa
'the land of the long white cloud';
- a viewing of the award-winning film 'Whale Rider' with discussion from some of the creators of the film;
- discussion of the emerging 'New' Zealand.

HAPPY HOUR!
'Happy Hour' will take place from Monday to Thursday in the Exhibition Area, Level 5, Aotea Centre. Come and enjoy a drink and mingle in an informal and relaxed setting. It is a good opportunity for newcomers to get acquainted and establish contact with fellow delegates. Likewise, it is a great chance for friends and colleagues to meet up after the working sessions.
Monday's Happy Hour will be a special themed evening where the IBA and LexisNexis Martindale-Hubbell will be extending a special welcome to all young lawyers. Everyone is welcome to attend.
