SBL Task Force on International Multijurisdictional Commercial Practice

In the wake of the Enron, WorldCom and Andersen scandals, in preparation for the increasing movement by US and other national regulators to attempt to apply laws extraterritorially to foreign lawyers, and due to the increasing complexity of cross-border commercial practice in our shrinking world, this Section on Business Law Task Force has spent this year identifying the most serious practical problems and challenges that impact lawyers in cross-border commercial practice. With conflicting rules of professional conduct and practice regulations, international practitioners are often caught 'between a rock and a hard place'. The Task Force has been working this year to:
  • Identify responses to emerging trends that will enhance and protect the rights of commercial lawyers operating in a globalised world.
  • Lead the profession in developing or promoting convergence of laws and codes to solve existing problems or trends that threaten or impede international cross-border commercial legal practice.
  • Provide pragmatic 'best practice' recommendations to assist the profession.
Come hear the Task Force's recommendations, and participate in an open debate on the need for continued and collaborative action between Bar Associations, Law Societies and private practitioners as these extremely complicated and complex issues are addressed. It is expected that the work of this Task Force will be instrumental as the IBA considers an Association-wide cooperative effort to broaden its work in this most fundamental and important issue concerning the international practice of law.

Corporate Social Responsibility: providing sound advice to the business client

Businesses today ignore social responsibility obligations and expectations at their risk and peril. How can counsel provide sound advice to business clients in this rapidly developing field which is incorporating concepts and approaches which may be new to the business law practitioner?

This Showcase Session will help provide answers by reviewing the business and legal cases for corporate social responsibility. It will ask what are and are not the human rights, labour and environmental implications of social responsibility? How can international frameworks, such as the UN Global Compact, or international accountability mechanisms such as the Global Reporting Initiative help the understanding of social responsibility expectations and avoid pitfalls? What are the most recent developments on the national level with regard to norms and litigation in the social responsibility field? The IBA's Corporate Social Responsibility Panel, comprising representatives from all parts of the IBA as well as distinguished experts, will report on their activities and discuss future projects.

Combating terrorism: the challenge facing states

The IBA has been actively involved in the fight against terrorism. In 2001, it created the Task Force on International Terrorism which considered some of the most critical legal issues facing the global community in response to terrorism. In its report, to be published in October 2003, the Task Force has reviewed the international legal framework within which states may legitimately wage war against terrorist organisations.

This session considers the struggle against terrorism from the perspective of the state. It considers how states interpret their international obligations while taking steps to protect their citizenry. The speakers will explore how governments strike a balance between the rights of the individual and those of the wider community.

The floor will then be opened up to the IBA membership to enable participation in this most important of discussions.

Globalisation of the legal profession: HOT TOPIC

In line with the tradition developed over the past few years, this highly interactive session will address a current essential issue facing the legal profession as the effects of globalisation continue. Experts including managing and senior partners of multinational law firms and bar leaders will debate the specific topic, which will be chosen in close proximity to the Conference to ensure timeliness. As in the past this session will take the form of a workshop, with active audience participation strongly encouraged.

Last year's session in Durban debated the long-term results and fundamental effects on the profession of the then recently signed US Sarbanes-Oxley Act.
